Abstract
This article deals with a particularly difficult constellation in the law of mistake which has not yet been satisfactorily resolved. It concerns cases in which the seller errs as to the value-enhancing qualities of the object sold: he sells a painting by a great master thinking it is worthless, or a piece of land without knowing that it is rich in mineral resources, etc. Using leading cases from the highest courts in France, Germany, Italy, the Netherlands and the United States as a starting point, this paper seeks to find a suitable solution to this problem. It adopts a pluralist research methodology: the cases are analyzed from the perspective of comparative law, legal ethics, legal history, law and economics and legal doctrine.
